Americans For
Prosperity and Kansas Judges |

| Approximately about a month
ago, Patriotic Thunder attended a
Americans For
Prosperity conference here in Wichita,
Kansas. In attendance were many state and
local representatives along with Congressman
Todd Tiahrt as the keynote speaker. When
we arrived, the place was bursting out at the
seams with people until they opened up another
divider to suit the over-crowding of the people
that showed up. Of course, as it always
happens to Patriotic Thunder, we happened to
seat ourselves between a Ron Paul supporter and
on the right, the Sam Brownback supporters.
However, the Ron Paul supporter was very
informed, and polite. We discussed many
issues, including Ron Paul's lack of supporting
our troops (visiting them in Iraq or anywhere
for that matter) and his remarks during the
Presidential debates. The Sam Brokeback
(yes, we spelled it wrong for a reason) were the
typical elitist campaign supporters, they
ignored us, and thank goodness. As the
case may be, were happy they did show up, unlike
many others that should of. Like our
Kansas Judges, because what we heard absolutely
disgusted us about them. |

After the deluge of facts
presented by Congressman Todd Tiahrt, State
Representative Lance Kinzer took his perch
at the podium. Rep. Kinzer spoke about how
new legislation was going to be
introduced/debated in 2008 year on how Kansas
Supreme Court Justices are selected. We
loved how he included his wife (a lawyer) in his
discussion and depicting how Kansas Justices are
selected to take part in this honor. Now
most of you would think that to be a Supreme
Court Justice in Kansas it would be a long drawn
out process which would include many hearings,
the Governor, voting by state legislatures,
etc... WRONG, it's a half-baked,
southern-fried, good ole' boy club of elitist
lawyers that sit around and say, "Who we going
to pick for this new opening for Supreme Court
Justice in Kansas?" Yes, that's exactly how it
happens. Kudo's to Rep. Kinzer for trying
to make a change through legislature to stop
this injustice. |
| Here comes a shocker, The
Judge to your right is Patrick McAnany of the
Court of Appeals of Kansas. He recently
gave his opinion/decision that one Nicholas L.
Martinez, aka Illegal Alien (Mexico), cocaine
dealer, endangering a child could not be charged
for being in Kansas Illegally. Judge
McAnany said, "However, while an illegal
alien is subject to deportation, that person's
ongoing presence in the United States is and of
itself is not a crime unless that person had
been previously deported and regained illegal
entry into this country". Okay, let me
break it down barney style for all of you.
What this Judge is saying is that if you break
into your neighbors house, it's not illegal if
you stay there, unless you leave your neighbors
house and try to come back. Now, how
asinine is that? Don't believe us, go
read it here yourself. |

| Were just warming up here,
The next judge is one District Judge Matthew
Dowd of Shawnee County. Now imagine this
for a moment, you commit seventeen felony counts
of sodomizing and raping a 14 year old little
girl. What is your punishment?
Depends, do you feel a little depressed?
According to Judge Dowd that's concern enough to
sentence you to probation. Yes, just
probation, that's all 38 year old Orlando Paul
Cisneros received as punishment. Now the
judge could of easily handed out 13 years of a
prison term but because Orlando was having a bad
day (depressed) at the time he was raping a
fourteen year old we should cut him some slack.
Hey, this is just one case, according to the
Kansas Sentencing Commission 66 felony accounts
in Shawnee county were "departed" in 2006.
The legal term for departed is something in
Kansas which refers to when a judge doesn't want
to follow what the law states for sentencing.
Convenient some would say, make's you
wonder who the real judge, jury, and executioner
is and why "we the people" have laws in the
first place? Were not
just picking on Shawnee County either, here's a
record of a judge in Douglas county.
District Judge Paula Martin of Douglas County
decided that a couple of men that committed a
rape of a 13 year old little girl should carry a
sentence of probation. Why you ask,
because according to this Judge, the little girl
was drunk and therefore an active participant.

The lady (Claudine Dombrowski)
in this picture was violently beaten by Hal
Richardson, the father of her baby and
ex-husband. Now Hal Richardson isn't
exactly going to win any father awards this year
for this, and his criminal record keeps growing
(Battery,
Attempted Battery, Battery of a Law Enforcement
Officer, Obstruction of Legal Process,
Possession of Marijuana and violation of Open
Container law.)
Shawnee County Judge James P.
Buchele refused to permit testimony in this case
because his docket was full. If that
wasn't bad enough, Claudine was ordered by this
Judge to move back to Shawnee County so Hal
Richardson could be closer to her daughter and
ordered her not to call the police when dealing
with her husband, all calls had to go through
her case manager first. Allegations of
death threats, rape and the killing of her
daughter were what the Judge was not letting get
into testimony. Outrage, to say the least,

| Okay, enough already, that
last story is just wretched. First off,
ask yourself this question, do judges make bad
decisions? Of course they do, just like
anyone who makes a choice does. To be
fair, judges make all kinds of decisions
everyday that can effect you and I detrimentally
as the reason your seeing the Judge. The
problem isn't the Judges, it really lies with
the criminal justice system in itself. Is
it a perfect system, of course not, not everyone
is going to agree on the outcome. However,
the Judges need to police each other. Now
we know, there is a state agency for that, but
seriously, how many District Judges have been
removed in Kansas from the Bench? One, and
it was so long ago Kansas records can't even
remember what he was removed for. Now if a
Judge does make a bad decision as clearly stated
in the cases above, should he/she be able to
correct that decision, or are they to high and
mighty to correct their injustice after they
have had some time to reflect? Some would
say that's what the court of appeals are for,
but why, come on, why does it have to even go to
something like that?
Why do Judges entertain such
nonsense? For instance, the spilt
McDonald's coffee and the woman receives
millions, or the burglar who falls through a
skylight and sues the homeowner and wins a
settlement. This is just absurd and Judges
need to be held to account for letting these
cases even be presented in their courtroom.
It's simple, listen to each others arguments and
inject some common sense and law into it.
If it's an absolutely absurd complaint then
dismiss it already....leave the story tellers to
the librarians'. Common sense says
if you rape a little girl or beat the hell out
of your wife you shall get punished for that in
a severe matter. However, the law states
otherwise, and the list of outrage goes on.
We believe at Patriotic Thunder that a Judge
should have the ability to "depart" from the
traditional sentencing, but dammit, use some
common sense in ALL your cases and throw out the
absurd ones, don't entertain this crap. |

In Closing, were sorry we
haven't been keeping the Local Issues updated
more frequent. We will, especially since
were heading into legislation again. If
you want to blame someone, blame your Imperial
Federal Democrat leadership, they've been
keeping us very busy with their lies and
pandering statements.
Ending on a good note, here's
a couple patriots that were also speaking at the
Americans for Prosperity.

| Rep. Kasha Kelly was awesome,
she definitely has a knack for speaking.
Her topic of discussion was "Fiscal
Transparency". We apologize for not being
able to quote her, but the gist of the
presentation was how Kansas currently doesn't
have a way to track where every dollar goes.
Whether it goes to this lobbyist or that state
agency or to whomever, Rep. Kelly talked about
how now their is. She along with other
Representatives have put a website together to
track Kansas government money. With Kansas
government job rate being #1 in the United
States and spending by Kansas government at a
rate of 1.3 Million dollars of your money an
hour.........YES, that is correct, 1.3 million
dollars an hour is spent by your lovely Kansas
government, we need to know where it is going.
Kudo's to Rep. Kasha Kelly for her hard work and
supporting Americans for Prosperity.
State Senator Tim Huelskamp came
out firing away with facts about Eminent Domain
and taxpayer funded lobbying. We
personally thought that this would be a
politicians' dirty little secret, even at the
state level, but Sen. Huelskamp laid it all out
on the table for us. Even Politicians'
like himself are bombarded by local interest
groups and lobbyists from corporations everyday
at the Capital. What we thought was
interesting was how he clearly depicted that
Americans for Prosperity, although grassroots,
lobby strictly for the people. The
people's issues, not corporations or lobbyists,
is what Sen. Huelskamp enjoys when a
representative of the people is their to talk to
him about the issues that concern us.
Great Job Senator.
Americans for Prosperity comes
across as a very welcoming group of individually
minded people. They emphasize their
efforts on lowering government spending and
reducing taxes. Well heck, those two
things right their will keep you busy enough.
Government spending in itself has increased to a
rate that must stop, Kansas is in debt to it's
eyeballs, those eyeballs cost Kansas taxpayers
429 million dollars a year in interest alone.
How much do we owe in debt Kansas citizens?
4 BILLION... That's why we like Americans
for Prosperity, they give you the hard facts,
black and white, digits and zero's. As for
lowering taxes, it's simple really, it's called
the FairTax, not a perfect plan because it
doesn't repeal the 16th amendment but it's a
hell of a start in heading in the right
direction and future of our state and country.
